1.  Application / area of application:

AndalusienShop pursues following Internet address

www.andalusienshop.com

in each case an on-line shop, which in particular offers articles of to purchase. For all orders under these Internet addresses, exclusively the following GBT's apply in the version valid at the time of the order. We do not recognize divergent regulations of the customer, unless, we would expressly have agreed to there validity.

2. Important Notes

2.1

The products offered at the online shop named under 1. are shown as close as possible according to the reality. Nevertheless, AndalusienShop is not able, with the displayed pictures and colors which the customer sees on his screen, to guarantee the quite precise correspondence with the reality. Minor deviations between representation and reality show no lack of the ordered product.

2.2

We point out the fact that products presented at the online shop named at 1. could be no more available at the time of the customers visit on the Internet page or/and the displayed price could have changed. The given prices are always euros and the prices are always BRUTTO, including VAT.

3. Completion of the contract

3.1

The contract between the customer and AndalusienShop, regarding the products placed in the basket, is valid at the moment the customer finalized the order by clicking “send order” and the acceptance of this order by AndalusienShop, confirmed by e-mail to the e-mail address provided by the customer at the time of order or with the delivery of the ordered product(s). In the order form the customer accepts the general terms of business for the AndalusienShop.

3.2

By ordering and accepting our GBT's the customer declears that he his minimum 18 years of age and fully able of conducting business.

3.3

In the case that our supplier is not able to deliver the product(s) ordered by you, we are  entitled to cancel the order. In this case we will inform the customer immediately about the fact that the ordered product is not available. Should the purchase price be already paid, any funds will be immediately refunded.

3.4

The buyer is aware of the fact that he closes a bill of sale by an electronic order with a  "mouse click. The buyer is obligated to accept the purchased object(s) within eight days from receiving the supply announcement. In case of the none acceptance of this product(s), AndalusienShop is entitled to make use of his legal rights.

If  AndalusienShop requires compensation, the compensation is always 10% of the purchase price. The compensation can be higher or lower if AndalusienShop or the buyer can proof a higher or lower damage.

4. Terms of delivery and shipping

4.1

Provided it is not agreed differently, the delivery occurs from storage to the delivery address provided the customer. Any information about the delivery time is non-binding, excluding the date of delivery was agreed by AndalusienShop.

We deliver worldwide

4.3

All deliveries occur either with the Spanish post "CORREOS", or with a logistics service provider of our choice.

For shipments outside the EU, the customer is responsible for duty/customs  regulations including all fees and costs. AndalusienShop refunds no confiscated product(s) and no duty/customs fees.

The shipment expenses are calculated by dispatch zones.

4.4

The responsibility for the ordered goods goes over to the customer at the moment when the goods leave our storage and are handed over to the logistic provider, this applies also to part deliveries. If the customer does not accept he delivered product(s), AndalusienShop has the right and is entitled after the expiry of an extension of two weeks to withdraw from the contract or to require damage payments because of non-fulfilment of the contract..

4.5

Any customized manufactured product(s) are excluded from the right of return. Except the delivered product does not correspond with the order. Returned product(s) must be complete and undamaged and in the original and undamaged packaging, all etiquettes and  protective foils must be in place. The goods must be returned in their original condition and packaging, as delivered by AndalusienShop. The delivered goods are also to be accepted by the customer in cases of unimportant defects, the customers guarantee rights won`t be affected.

4.6

If the goods are available we deliver as fast as possible by postal or parcel service Available goods we send within 2  to 4 working days.

All shippings occur on responsibility of the customer. Every shipping where an external damage is recognizable, is to be accepted by the receiver only with the statement of the damage by the logistic provider. If the receiver doesn´t obtain the damage statement from the logistic provider, no claims or damages by the customer can be forwarded to and accepted by AndalusienShop afterwards. AndalusienShop is not liable for any delays in delivery if AndalusienShop hasn´t confirmed the delivery date in writing before. In this case our obligation is restricted to accept the returned goods free of charge.

4.7

The buyer has to indicate evident defects immediately, within 2 working days with AndalusienShop by email.

Returns of any kind must be arranged with us! Not free sent product(s) is/are not accepted!

Complaints: The product must be sent free to us. Please, add to the returned product(s) a precise mistake description. Only by entitled complaints we re-compensate the forwarding expenses.

5. Payments

AndalusienShop only accepts payments as indicated. Is the ordered product(s) not  available, amounts paid will be immediately refunded.

5.1 Advanced Payment

Advanced payment is effected immediately after the order. Contract acceptance and dispatch occur only after payment entrance. As long as the total payment of the ordered product(s) and shipping expenses is not confirmed within 8 working days since order by our bank. AndalusienShop is entitled to cancel the order.

5.2 Online Security

In order to optimise transaction security over the Internet, an SSL (secure socket layer) on-line payment system is proposed to the customer, which enables the customer's credit/debit card number to be encrypted, with a 128-bit key.
At the same time, the guarantees given by the Company in the context of transaction security are identical to those obtained by the Company from software manufacturers.
Warning: in order to benefit from the SSL secure on-line payment method, the customer must use browsers compatible with the SSL system.

6. Retention of title

AndalusienShop expressly reserves ownership of delivered Products until full payment of their price in principal and interests. The above conditions do not preclude the transfer of the risks of loss or deterioration to the customer. In the absence of full settlement, the Company shall legally demand the return of the Products delivered at the customer's expense.

7. Defective delivery / liability

The legal regulations are applicable.

7.1 Complaints

7.2 Liability limitations

If not otherwise mentioned below any further claims of the customer – with whatever legal arguments – are excluded. Therefore, AndalusienShop is not liable for damages which have not originated in the object of delivery, in particular AndalusienShop is not liable for lost profit or for other property damages of the customer. As far as the liability is excluded or limited for AndalusienShop, this also applies to the personal liability of employees, representatives and contractors of AndalusienShop. Preceding restriction of liability does not apply, if the damage is caused by intention or coarse carelessness or a personal damage is involved, also if the customer claims within the Product liability law. Provided that AndalusienShop violates negligently a contract-essential duty, the obligation to indemnify is limited to compensation up to the amount paid by the customer in the context of the price of the product and the shipping costs.

8. Data processing

The data sent to us is stored for proceeding the order. The Data will not be transmitted to a third party

9. Cooling-off period

The cooling-off period granted to the customer on the purchase of goods, under the terms of the law, is 7 (seven) days from the date his/her order is received. During this period, the customer may return the undesired Product(s), at his/her own expense and with no other penalty charges.
It is acknowledged that the Product(s) returned at the customer's expense should be in its (their) original condition and packaging, as delivered by the Company.
No Product may be reimbursed before having been returned by the customer and received by the Company, in its original condition and packaging, as delivered by the "Company". In particular, the Product shall not have been unsealed.

10. Partial ineffectiveness

With ineffectiveness or partial ineffectiveness of single regulations/terms or parts of the regulations/terms, remain the other regulations/terms valid.

11. Applicable Law

Spanish law is applicable.
